Finding your way in OHS is no longer something to be ventured into lightly. Below are some of the Acts which have equal impact nationally, and only relates to Dept of Labour. Please keep in mind that this list is by no way exhausted. Many other Acts governing specific industries, or employment sectors, supported by various Regulations, both Nationally and Provincially, forms part of the complete Health & Safety Management requirements. For this very reason it is vitally important to ensure full and comprehensive competence in the appointment of any OHS position. As a lack of exposure, qualifications, experience and knowledge will most likely result in disaster for any business, and even worse for the CEO or Owner.
The list and complication level increases dramatically when Section 9 and 37(2) of the OHS Act is kept in mind and understood. TheCEO or Employer is responsible for the safety and well-being or all persons on any premises under his control (Sec 9), this includesvisitors, public and clients. Then in terms of 37(2) Employers are equally responsible to ensure that all contractors to them comply with not only the OHS Act, but also to their own and specific Health & Safety Management system, and has to ensure and enforce compliance thereto. This include and requires Induction of contractor's staff on your HSM.
 
Even more concerning is the fact thatyour insurance may very well be clued-up already, and will not indemnify you against claims, both injury and loss like fire, should your OHS not be in place, and may have avoided or reduced the injury or loss. So, take the time and speak to your insurer directly, not just your broker, as we have encountered many claims been rejected as a result of non-compliance. Your policy fine print will undoubtedly refer to instances where you are found to be in contravention of any Act or Regulation, and as such act unlawfully.
